Template: Request for Decision/Acceleration in the Czech Republic for Family Members of Union Citizens

In the Czech Republic, family members of EU citizens can apply for a residence card based on Directive 2004/38/EC, but the processing by the competent subordinate authority often takes longer than expected. The following template is therefore addressed to the supervising authority, the “Komise pro rozhodování ve věcech pobytu cizinců,” after the 60-day deadline for issuance has passed. The included requests give the subordinate authority an additional week to process the application. If this period is also not used, the supervising authority will take over the case and decide on the issuance of the residence card itself. The template is intended to help family members of Union citizens in the Czech Republic obtain a binding decision more quickly.

Please always submit applications in Czech or in a bilingual format. The template must, of course, be adapted accordingly. Ensure beforehand that all requirements for issuance are actually met and that all necessary documents have been submitted.

Dear Sir or Madam,

hereby we apply

• to request the executing authority to issue the requested EU residence card for the family member of a Union citizen by [DATE 7 DAYS LATER].
• to take over the case after [SAME DATE AS BEFORE] and make a decision in place of the competent authority.

Justification:

The timeframe of 60 days according to Section 169t par. 6 letter f) of ARFN since submission of the application has passed without any decision in the case [CASENUMBER].

All requirements for granting the permit have been met. All required documents have been submitted with the corresponding translation.

In addition, I would like to point out that I, [NAME OF UNION CITIZEN], have already received my temporary registration certificate for Union citizens. Therefore you have already acknowledged my rightful stay in the Czech Republic.

Because of this, [NAME OF FAMILY MEMBER] has the right to reside together with me within the Czech Republic as a family member of a Union citizen.

Attached you may find again a copy of the initial application along with the [LIST OF DOCUMENTS LIKE MARRIAGE CERTIFICATE].

Translation proposal in Czech

Vážené dámy, vážení pánové,

tímto žádáme:

aby příslušný úřad vydal požadovanou kartu pobytu EU pro rodinného příslušníka občana Unie nejpozději do [DATUM, O 7 DNÍ POZDĚJI],

aby případ po [STEJNÉ DATUM JAKO V PŘEDCHOZÍM BODU] převzala a rozhodla místo příslušného úřadu.

Odůvodnění:

Uplynula lhůta 60 dnů podle §169t odst. 6 písm. f) zákona ARFN od podání žádosti, aniž by bylo ve věci [ČÍSLO PŘÍPADU] rozhodnuto.

Všechny podmínky pro udělení povolení byly splněny. Všechny požadované dokumenty byly předloženy spolu s odpovídajícími překlady.

Dále bych chtěl/a upozornit, že já, [JMÉNO OBČANA UNIE], jsem již obdržel/a svůj dočasný doklad o pobytu pro občany Unie. Tím bylo již uznáno mé oprávněné pobývání v České republice.

Na základě toho má [JMÉNO RODINNÉHO PŘÍSLUŠNÍKA] právo pobývat se mnou v České republice jako rodinný příslušník občana Unie.
